Description of a Trust
A trust is an agreement between the settlor (or donor) of assets and the trustee (who manages those assets). Although the agreement is in written form it is not registered anywhere and so remains confidential between the settlor and the trustee. The agreement can be very flexible giving a wide choice of who may be able to benefit from the assets donated (the beneficiaries), when they may benefit and by how much. A trust may last for many years and during that time the benefits given to beneficiaries can be varied to suit changing family circumstances.
Guernsey trusts are subject to the provisions of The Trusts (Guernsey) Law 2007 which provides the legal framework to protect the settlor's wishes and the rights of the beneficiaries whilst permitting the trustee sufficient flexibility to manage the assets efficiently.
